2. Requesting a Quote or Consultation

When You submit a request for a quote, consultation, or appointment through the Service, You agree to provide accurate, current, and complete information. Submitting a request does not guarantee availability, pricing, or that the Company will accept the project. Any final pricing, timeline, warranty terms, and scope of work will be set out in a separate signed contract prior to the start of any work.

3. Text Messaging (SMS) Terms

If You opt in to receive text messages from Us, You agree to the following:

  • Consent to receive SMS messages is not a condition of any purchase or service.
  • Message and data rates may apply. Message frequency varies based on Your interactions with Us.
  • You may receive messages related to customer care, appointment scheduling and reminders, project updates, and — where You’ve consented — marketing or promotional offers.
  • Reply STOP to any message to opt out at any time. You will receive one confirmation message and then no further texts unless You opt in again.
  • Reply HELP for support, or contact Us using the information in Section 11 below.
  • Carriers are not liable for delayed or undelivered messages.

4. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of BLU WTR Pool Renovations and Repair LLC and its licensors. 5. Project Photos and Testimonials

By submitting photos, reviews, or testimonials to Us (including “before and after” project images), You grant the Company a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content on the Service, in marketing materials, and on social media, unless You notify Us otherwise in writing.

6. Links to Other Websites

Our Service may contain links to third-party websites or services that are not owned or controlled by the Company. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that the Company shall not be responsible or liable for any damage or loss caused by or in connection with the use of any such content, goods, or services available through such websites.

7. Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Company makes no warranties, expressed or implied, regarding the operation of the Service or the information, content, or materials included on it. Any workmanship warranties applicable to pool renovation or repair work will be set out separately in Your project contract, not in these Terms.

8. Limitation of Liability

To the maximum extent permitted by law, in no event shall the Company, its directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to Your use of the Service. This limitation does not apply to liability arising from a separately executed project contract for renovation or repair services.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

10. Changes to These Terms

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, We will provide reasonable notice prior to the new terms taking effect and update the “Last updated” date above. Your continued use of the Service after any revisions become effective constitutes acceptance of the new Terms.
